By means of this document, the agreement between Motear and the User is established , the latter being understood as any natural or legal person that uses the services that Motear SAS offers. For this reason, it is established that any person who wishes to use the services of Motear must be subject to doing so under the Terms and Conditions that are set out below.

 

 

1 First

 

Any person who carries out a transaction in the virtual store must do so by providing their own and real information. Any real or legal person who impersonates or provides false or stolen information will be sanctioned under the laws of Colombia.

 

Motear under no circumstances is responsible for the actions of third parties of any of the kinds mentioned in the previous paragraph, or for purchases or transactions made with false or supplanted information.

 

 

 

2 Second

 

It is mandatory for the User to provide the information required by the page in a real way for the registration and payment processes. It is not the responsibility of Motear to verify the information provided by the User since the good faith of the individual is presumed.

 

Motear reserves the right to cancel a subscription or personal account without the need for explanation to the User . He will not be entitled to any kind of compensation for this fact. It also reserves the right to request additional information from anyone to corroborate the data provided by it.

 

The User will be responsible for all the operations carried out in his account since it is unique, personal and non-transferable. That is why Motear recommends that the Total User reserve against the information used for the 'Login' (email address or username and password).

 

The User agrees to notify Motear using the means provided by the platform as soon as possible of any anomaly, incorrect operation or theft of his personal account.

 

 

 

3. Third

 

Motear may change the provisions of this agreement. All changes will be published on the Terms and Conditions page and will take effect 15 days after their publication and the User will be notified by electronic means. The User may notify in the first 6 business days that he does not accept the changes and the agreement between both parties will be canceled if there are no debts or pending by the User.

 

 

 

4. Fourth

 

Motear assures the User that they do not have any access to personal financial information such as debit or credit card numbers, account number or password. The transaction is not done through speckle but by third parties, totally secure and legal platforms for online payments.

 

 

 

5. Fifth

 

Regarding the information provided in the registration, Motear may make personal use of the information provided by the User to carry out marketing campaigns, telephone contact or others. This information will not be supplied for any illegal, unethical and ethically wrong purpose.

 

 

 

6. Sixth

 

Motear ensures that the price that appears to the public is the final price (includes IVA). No more will be charged than what is established in the description of the product except in cases where shipping is charged.

 

 

 

7. Seventh

 

Because Motear operates only in Colombia , the payment system will verify that both the IP and the card and / or account number are national. Payment with international cards or from IP is not allowed in countries other than Colombia.

 

Similarly, no shipments will be made to clients abroad, even if they have paid with Colombian credentials.

 

 

 

8. Eighth

 

Any action or use of software that seeks to destabilize or interfere in the activities or operations of Motear will be sanctioned in reference to the laws established for such cases in the country. Any attempt or interference with intellectual property rights or unauthorized copying of databases or information owned by Motear will be sanctioned in the same way.

 

 

 

9. Ninth

 

Any third party that causes damage or harm to Motear , in addition to receiving the sanction according to current Colombian laws, must also indemnify Motear for the damages caused.

 

 

 

10. Tenth

 

Motear is not responsible for computer damages incurred to the User as a result of system, server or Internet problems; nor of viruses that could infect the computer after accessing the web portal. The user may NOT impute to Motear any responsibility of this type or demand any compensation or payment for any damage of this type.

 

 

 

11. Eleventh

 

Motear undertakes that, on its own part, no act of an IT nature will be carried out that could affect the User , as well as attesting to its interest in the safe navigation of the User through the Web portal. Motear does not guarantee that the site is always available as it is not free from any technical difficulties; in this case, it undertakes to solve it as soon as possible.

 

 

 

12. Twelfth

 

Registration in Motear is completely free, there is no charge for registering, viewing or browsing the web portal. Motear reserves the right to change the prices of any of its products at any time it wishes, always making the change visible in the product description. You can also carry out promotions, discounts or others at the time you want.

 

 

 

13. Thirteenth

 

Speckling has its own rating system users according to different filters so reserves the right to categorize them according to different groups such as Premium or others; different rates, conditions, promotions or others may apply to these.

 

 

 

14. Fourteenth

 

Motear is protected under international laws of copyright, patents, models and industrial designs. All screens related to the services provided by Motear are its intellectual property; as well as programs, databases, social networks and / or other own files; Any copy, reproduction or improper use of these will be sanctioned according to international intellectual property laws.

 

 

 

15. Fifteenth

 

The shipping process is outsourced to logistics companies; In case of damage or loss of the product due to errors in these, Motear is not responsible for compensating the User and the User may not in any way take legal or other measures that harm Motear .

Similarly, Motear is committed to hiring companies that are duly certified for this management and that provide security and guarantees in shipments. In cases of damage or loss that harm the User , Motear gives a guarantee that it will support and do what is in its power to manage compensation from the carrier.

 

 

 

16. Sixteenth

 

Usually shipping to major cities can take up to (10) business days after payment is verified. Business days are Monday, Tuesday, Wednesday, Thursday and Friday, as long as these are not holidays.

 

 

 

17. Seventeenth

 

Any questions or concerns that the User presents about the Terms and Conditions that have been established in this document may be communicated to the email secure_mail@motear.xyz. There will be four business days for Motear to give an answer.

 

 

 

18. Eighteenth

 

The User who uses the services of Motear agrees to accept the Terms and Conditions set out in this document. Ignorance of this document does not exempt you in any way from violating any of the clauses and agreements that have been raised or the legal and legal consequences in which Motear is covered.
